These Terms govern your access to and use of Binds and our connected software products. Drafted in simple, transparent language in compliance with Indian laws.
- Clear ownership: You own your content and data; Binds owns its software platform.
- No abuse: You agree to use our tools responsibly without spam, harm, or unlawful activity.
- Indian IT Act compliant: Electronic agreement governed under applicable Indian statutes.
- Grievance redressal: Dedicated officer with statutory response timelines under IT Rules.
01 Acceptance of Terms & Electronic Contract
These Terms of Service (“Terms”) constitute a legally binding electronic agreement between you (“User”, “you”) and Binds (“we”, “us”, “our”), governing your access to and use of binds.si and its associated software products (including ESignify, Class Hero, Click2Fix, and Social Posty).
This document is an electronic record published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Section 10A of the Information Technology Act, 2000. It does not require any physical or digital signatures. By accessing, browsing, or using our websites and services, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
02 Eligibility & Legal Capacity
Under the Indian Contract Act, 1872, you must be at least 18 years of age and legally competent to enter into a contract to use our services independently. If you are under 18 years of age (for example, in educational workflows such as Class Hero), you may only access the platform through an account registered or supervised by a parent, legal guardian, school, or authorized institution that agrees to be bound by these Terms.
If you use our services on behalf of a company, organization, or institution, you represent and warrant that you possess full authority to bind that entity to these Terms.
03 User Accounts & Security
When creating an account or workspace across any Binds product, you agree to:
- Provide authentic, accurate, and current information.
- Maintain the confidentiality of your login credentials and security tokens.
- Promptly notify us via our Contact Desk upon discovering any unauthorized access or security breach.
- Take responsibility for all activities occurring under your authenticated credentials.
04 Acceptable Use & Prohibited Conduct
In strict compliance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree that you shall not host, display, upload, modify, publish, transmit, store, update, or share any information or content that:
- Belongs to another person and to which you do not have any right or authorization;
- Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, or unlawful;
- Infringes any patent, trademark, copyright, or other proprietary rights;
- Violates any Indian law for the time being in force;
- Deceives or misleads the addressee about the origin of the message or knowingly communicates false or misleading information;
- Impersonates another person or entity;
- Contains software viruses, trojan horses, worms, or any malicious computer code designed to disrupt, destroy, or limit the functionality of any computer resource;
- Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order.
Additionally, you shall not attempt to reverse engineer, decompile, scrape systematically, probe security vulnerabilities, or overload the infrastructure of Binds.
05 Intellectual Property Rights
Our Platform: All right, title, and interest in and to Binds, including our software, user interfaces, brand names, visual identity, logos, code, and documentation, remain the exclusive property of Binds and its licensors, protected under applicable Indian and international intellectual property laws.
Your Content: You retain complete ownership of all data, text, files, and materials you upload or transmit through our services (“User Content”). You grant Binds only a limited, revocable, non-exclusive, royalty-free license strictly to store, host, and process your content as necessary to operate and deliver the service to you.
06 Third-Party Services & Integrations
Our products may offer integrations with third-party software, identity providers, or cloud services (such as Google Workspace, Microsoft 365, or social media platforms). Your interactions with these third-party services are governed solely by the terms and privacy practices of those respective third parties. Binds is not responsible for third-party platforms.
07 Service Availability & Modifications
We strive to keep our services dependable, secure, and continuously available. However, our services are provided on an “as is” and “as available” basis. We reserve the right to modify, enhance, or temporarily suspend features for maintenance, security patches, or platform updates with reasonable notice where practicable.
08 Limitation of Liability & Disclaimers
To the maximum extent permitted under applicable Indian laws, Binds, its founders, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, goodwill, data, or business interruption, arising out of or related to your use or inability to use the platform.
Nothing in these Terms excludes or limits liabilities that cannot be excluded under applicable Indian statutory law.
09 Termination & Suspension
You may stop using our services and request account deletion at any time. We reserve the right to suspend or terminate your access immediately if you commit a material breach of these Terms, violate applicable laws, or engage in conduct harmful to other users or the platform.
10 Governing Law & Dispute Resolution
These Terms shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India, without regard to conflict of laws principles.
Any dispute, claim, or controversy arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts located in India.
11 Grievance Redressal Mechanism
In compliance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Binds has appointed a designated Grievance Officer to address user grievances, complaints, and compliance inquiries.
Please specify “Grievance Redressal - IT Rules” in the subject line of your email along with relevant details to ensure prompt processing.
12 Contact & Updates
We may revise these Terms periodically to reflect evolving legal frameworks or product enhancements. We will indicate the “Last Updated” date at the top of this document. Continued use of our platform after updates constitutes your acceptance of the revised Terms.
